PART III

Powers, Authorities, Duties, Functions and Obligations

of the Hong Kong Port Trust

(1) The Port Trust may employ such professional, technical and

other officers, clerks and employees as it may deem necessary for the

proper conduct of its business and fix their remuneration.

(2) Any employee of the Port Trust, who at the time of his appoint-

ment under or pursuant to the provisions of this Ordinance, holds a

position in the Public Service shall at his option continue to retain

and to be eligible to receive all the benefits, except salary as a

Civil Servant, that he would have been eligible to receive had he remained in Public Service, [in lieu of the rates of pay, conditions

of service and privileges prescribed from time to time for officials

and servants of the Port Trust.

The officers and employees so appointed and employed shall

continue in the employ of the Port Trust at the will of the Port

Trust only. Such persons so to be appointed and all persons trans-

ferred to the Port Trust from Government departments shall be subject

to the sole control and governance of the Port Trust. No person so

appointed or transferred shall be permitted to engage in any employ-

ment other than in connection with the duties of his office without

the sanation in writing of the Port Trust.

(2) The Port Trust may from time to time make regulations in regard

to the officials and servants of the Port Trust.

(a) Regulating their grades, pay, allowances and conditions of

service.

(b) Prescribing the manner of dealing with offences against

discipline and the punishment of offenders by dismissal or

otherwise.

(c) Establishing provident funds or pension schemes, prescribing

the manner of contribution there to and in general regulating

the conditions under which pensions and gratuities shall be

payable to officials and servants or their dependants.

(d) Such regulations shall be submitted to the Governor in

Council be published in the Gazette, and take effect from

the date of such publication or from a later date to be
